MEDIATION

YOU CURRENTLY FEEL:

  • overwhelmed with trying to decide a parenting plan that is best for your children

  • frustrated and needing resolution

  • worried about the cost of litigation and the stress of going to court

  • unable to move any further in a dispute without additional help

  • like you just want to get this over with

WHY MEDIATE:

  • For parenting plans, mediation can humanize the process so as parents, you are choosing a plan that works best for your children, instead of a judge deciding.

  • Litigation gets expensive, and quickly! Mediation is cost effective alternative and can be done without a lawyer (in most cases!)

  • Agreements created in mediation are more likely to be followed than judgements.

What is Mediation?

Meditations and Facilitated Conversations are very similar. Both options are a time for all parties involved in a dispute to meet with a neutral third party to guide the conversation. The Mediator does this in a way that helps the parties work toward a solution or agreement. Mediations could be considered more formal and conclude with a legally-binding agreement, called a Memorandum of Understanding (MOU) written by the mediator. A facilitated conversation is a less formal meeting, guided by the mediator, to help the parties work toward solutions. These conversations conclude with a basic written agreement or a verbal agreement.

“Amy helped my siblings and myself figure out our aging father’s next living arrangements. She was so patient during the process and actually got us to agree, which is a huge feat!”

FREQUENTLY ASKED QUESTIONS

Are you a lawyer or can my lawyer be present?

I am not an attorney and I do not give legal advice. I am trained to guide the conversation to help parties come to a mutual agreement. Your legal council is retained to represent your interests specifically, while the mediator is neutral. Attorneys can be present during mediation.

How do I know if I need mediation?

If the parties are having trouble navigating an agreement, or would like to avoid litigation for a dispute, mediation is a great option. Mediation can humanize many otherwise cold processes, such as parenting plans or family disputes. Contact me directly to see if mediation is right for you and your situation..

Do you talk to only one of the parties in the meditation?

During the mediation, there is always the option to have a private, short, conversation with me called a Caucus. If you would prefer to have a one-on-one session, a Conflict Coaching Session might be a better option.

How many sessions will I need?

This will depend on your particular dispute and goals. Contact me directly for a personalized estimate.

How much does mediation cost?

Mediation and facilitated conversations are billed on an hourly basis. Contact me directly for a case specific estimate.

The energy between the parties is quite contentious. Do we have to be in the same room to mediate?

No, we can do a Shuttle Mediation where I move between the parties to negotiate the terms of the agreement.
